Looking over my notes from a class I took in February with Phoenix real estate lawyer Adam Martinez of Combs Law Group, I thought these items were useful and they might even reflect what Adam said.

  • No SPDS is a red flag for short sale buyers because the seller could very well have filled out a SPDS (Seller Property Disclosure Statement). Buyers might want to do more inspections than normal.
  • Home inspectors are only liable for their fee. If the home inspector misses something big and the error ends up costing the home buyer a lot of money, the home buyer is pretty much SOL. [My wording.]
  • If you want to sue somebody, be aware that judges usually only award 50% to 70% of attorney’s fees even if you win.

It was a worthwhile Arizona real estate class.
